This original application under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered on a letter petition dated 13.06.2022 received from the residents of Nagar Panchayat Banat, District Shamli, Uttar Pradesh represented through some of the Sabhasads of Nagar Panchayat namely Yogendra Sharma, Sunita, Imran, Kavarpal, Munisha etc.
The grievance is that there is illegal dumping of solid waste and C&D waste of road construction on both the banks of bridge over river Krishni at Nagar Panchayat Banat which is resulting in blockage of river flow reducing its width upto 3 pillars causing huge water pollution and health hazards to the local residents. The said dumping is being caused by Nagar Panchayat Banat in an illegal manner and they are causing damage to environment which is causing health hazards to the residents.
In our view, at the first instance, the matter can be examined and appropriate action can be taken to the effect of removing the solid as well as C&D waste from the banks of river Krishni and maintaining free flow of water, by the authorities concerned. Hence, we direct State PCB and District Magistrate, Shamli to look into the complaint and after verifying facts, take appropriate remedial and preventive action in accordance with law within two months which may require setting up to waste (social and C&D) processing and utilization facility.
With the above directions, this application is disposed of.
