This original application under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered pursuant to a letter petition dated 25.05.2022 sent by Secretary, Gram Panchayat, Development Block, Nagger, Post Office Kalath, Tehsil Manali, District Kullu, Himachal Pradesh.
The grievance is that there is illegal dumping of solid waste in the Gram Panchayat area of Gram Panchayat Shallen Village Rangadi, Post Office Kalath, Tehsil Manali, District Kullu causing health hazards faced by local residents including the students of Saraswati Vidya Mandir, DAV School and Bodh Shiksha Sansthan which are situated in the nearby area. It is also said that on account of eating of decomposed garbage thrown on open land, the cattles in the area are dying and about 40 cattles have already died. Further, the waste thrown in open is ultimately going/thrown in river Beas causing contamination of water.
In our view, the complaint made in this application can be looked into, at the first instance, by joint Committee comprising State PCB and District Magistrate, Kullu and if they find any violation of the environmental laws and norms, appropriate remedial action in accordance with law shall be taken expeditiously and in any case within two months from today and forward the report to the Registrar General of this Tribunal by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF. If necessary, the Registrar General may place the matter before the Tribunal for appropriate further order. District Magistrate, Kullu will be the nodal agency for coordination and compliance. The joint Committee needs to ensure that waste processing plant is duly authorized and complying with MSW Rules.
With the above direction, this Original Application is disposed of.
