This original application under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered on a letter petition dated 18.06.2022 sent by Harish Solanki complaining that there is a gross water pollution in District Burhanpur, Madhya Pradesh causing fish mortality in River Tapti and also air pollution causing mortality of birds by several industrial waste and air pollution. It is also said that CETP has been installed but they are non-functional, there is rampant cutting of forest, burning of forage resulting in cattle mortality due to hunger and tyres are burnt in boilers causing serious air pollution and health hazard.

Although, no specific violator is pointed out nor specific area is pointed out except that in the District Burhanpur, River Tapti is polluted besides air pollution, we find it appropriate to constitute a joint committee comprising State PCB and District Magistrate, Burhanpur to look into the grievance and take appropriate remedial, punitive and preventive action if the complaint is found to be correct. They shall forward the action taken report within two months to Registrar General, NGT by e-mail at judicial-ngt@gov.in preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF. If any further direction is found necessary, he may place the matter before the Bench.

The Application is disposed of with above direction.

A copy of this order along with copy of the complaint be forwarded to State PCB and District Magistrate, Burhanpur by email for compliance.
