Judgment
This Original Application has been registered under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) exercising suo-moto jurisdiction on a letter petition sent by residents/villagers of village Ekda, Post Office Bansjora, Police Station Loyabad, District Dhanbad, alleging that there is a River Joriya in the vicinity of village which provides water for drinking and other purposes to the villagers. For the last some time, Nagar Nigam, Dhanbad is dumping its solid and municipal waste on the bank of river, which is ultimately falling in river, polluting the river water, on account whereof, residents of village are suffering and polluted water of river is causing health hazards to the people at large.
Looking to the complaint made as noticed above, we find that a substantial question relating to environment due to implementation of Scheduled enactments under NGT Act, 2010 has arisen, but before taking any further action in the matter, we find it appropriate to obtain a factual Report for which we constitute a Joint Committee comprising District Magistrate, Dhanbad, Jharkhand State Pollution Control Board and representative of Principal Secretary, Department of Water Resources of Jharkhand.
District Magistrate, Dhanbad shall be the Nodal Agency for compliance and coordination.
Committee shall visit the site, collect relevant information and submit a factual Report within one month before Eastern Bench of this Tribunal.
Further, we find it appropriate to obtain response from certain concerned parties hence, we direct that following shall be impleaded as respondents:
(i) Principal Secretary, Department of Water Resources Department, State of Jharkhand, Nepal House, Doranda, Ranchi-834002,
(ii) Principal Secretary, Department of Urban Development, State of Jharkhand, Project Building P.O. Dhurwa, Ranchi-834004,
(iii) Chairman, Municipal Corporation, Dhanbad, Luby Circular Road, Dhanbad-826001,
(iv) District Magistrate, Dhanbad, Collectorate Building, Near Head Post Office, Dhanbad -826001,
(v) Jharkhand State Pollution Control Board, through its Member Secretary, H.E.C., Dhurwa, Ranchi-834004.
Notices shall be issued to the above respondents by Registry. The above respondents may file their reply/response within six weeks.
Since the matter relates to Eastern Zone Bench of Tribunal at Kolkata, therefore, Registry is directed to transmit record to the Eastern Zone Bench for further proceedings.
List before Eastern Zone Bench at Kolkata for further consideration on 01.08.2024.
A copy of this order be forwarded to District Magistrate, Dhanbad, Jharkhand State Pollution Control Board and Principal Secretary, Department of Water Resources of Jharkhand for information and compliance.
