Pritam kumar vs State of Jharkhand

This original application has been registered under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition received on 28.09.2022 by this Tribunal from Shri Pritam Kumar resident of Village Sudi, Dist Ramgarh, State of Jharkhand.

The complaint is that there is a local river in the area of village Panchayat of Chikor and Pali, in particular villages Sudi, Chikor, Ladi and Paali, wherein, within the prohibited area of the flood plain zone of river, a large number of stone crushers have been established causing damage to environment by contaminating river water and also effecting smooth flow of the river. The crushers are also causing noise pollution effecting health of the villagers of the nearby area.

In our view the issue raised in the application, at the first instance can be looked into by the local authorities and in this regard, we constitute a joint Committee comprising District Magistrate, Ramgarh, State PCB and Regional Officer, MoEF & CC Ranchi to look into the complaint, visit the site, collect relevant informations and if finds the complaint to be correct, to take appropriate remedial and preventive action, in accordance with law, within two months.

State  Pollution  Control  Board  shall  be  the  nodal  agency  for coordination and compliance of this order.

The final action report shall be submitted before the  Registrar, Eastern Zone Bench, Kolkata, by e-mail, preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF and if any further direction is required, the matter shall be before the Bench for further action.

With  the  above  observations  and  directions,  the  application  is disposed of.
