Judgment
The original application under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered on a letter petition dated 18.07.2022 received from a number of applicants i.e. Deenanath and others, who are all residents of Village Gram Panchayat Gauridih, Mohalla Makhdampur Malik and Mauja Madapur Samaspur Development Block, District Mau.
The allegation is that there is a pond (pokhri) in the village, near the residence of one Radheshyam, wherein rain water and other surface runoff is collected for water conservation and maintain habitats for birds etc. The said pond (pokhri) was also maintained by spending money under MGNREGA Act in 2010-2011. Now some miscreants namely Radheshyam and Vishundev sons of Jadhu, Ajit s/o Ramashray, Bheem s/o Radheshyam, Rahul s/o Vishundev, Jitendra s/o Komal and Vishwajeet s/o Jitendra have illegally encroached upon the land of the water body and disturbing ecology of the pond, damaging wildlife which is also resulting in water stagnation in the village adversely affecting the residents of the village and also causing health hazards.
In our view, the complaint and the grievance raised in the matter can be looked into, at the first instance, by local authorities, for the purpose whereof, we constitute a joint Committee comprising State PCB and District Magistrate, Mau who shall look into the matter, visit the site, collect relevant information and if finds any violation, would take appropriate remedial action in accordance with law within two months.
District Magistrate, Mau will be the nodal agency for compliance and coordination.
Further, an action taken report by the said Committee shall be submitted to the Registrar General by e-mail at judicial-ngt@gov.in preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF, who shall, if find necessary for any further order place the matter before the Bench.
The application is disposed of.
A copy of this order be forwarded to State PCB and District Magistrate, Mau by e-mail for compliance.
