Judgment
Heard M/s. Ch. Lakshmi Narayana, learned counsel for the petitioner, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 4.
The petitioner is aggrieved by the action of the respondent No.2 in not taking up case in File No.2823 of 2024 for hearing filed under section 10 of the Inam Abolition Act, 1955 with a prayer to call for the records relating to connected with Case No.L/2737/1989 dated 5-2-1990 and set aside the same as illegal, arbitrary and violative of Articles, 14, 300-A of Constitution of India and also section 3, 4 of A.P. District Collector's powers Delegation Act 1961 in granting Occupancy Right Certificate in Saheb Nagar, Khurd Village, Hayath Nagar, Mandal Hyderabad East Division by the respondent No.3 illegally and falsely mentioning as Inam Land as per Basic Revenue Records and except issuing notices on 15-7-2024 initially fixing the date as 17-8-2024 and later on 7-5-2025 fixing the date as 17-5-2025.
Learned counsel submits that the petition was filed under Section 10 of the Inam Abolition Act, 1955 by the petitioner, which has been numbered as Application No.F1/2823/2024 pending before the District Collector, Ranga Reddy District at Kongarkalaan. Learned counsel submits that the said case was filed on 11.06.2024 and till date the respondent No.2 has not taken up the case and though notices were issued two times, the matter was not taken up after 07.05.2025 and that the petitioner is a senior citizen of 87 years and prayed this Court that appropriate orders be passed to expedite the hearing of the case.
Learned Assistant Government Pleader for Revenue submits that appropriate orders be passed to the extent of disposing of the case of the petitioner.
Heard and perused the record.
In view of the submissions made by both sides without going into the merits of the case, this writ petition is disposed of directing the respondent No.2 to consider the case No.F1/2823/2024 filed by the petitioner for expedite hearing, after putting notice to respondent No.5 and all the interested and affected parties and grant a fair opportunity of hearing to the parties and on a proper enquiry shall pass appropriate orders within a period of six (6) weeks, from the date of receipt of a copy of this order. In view of the direction given to the respondent No.2 to issue notice to respondent No.5, notice to respondent No.5 in this writ petition is dispensed. If the respondent No.5 is aggrieved by this order, it is left open to him to avail remedy of filing application for the modification of this order in accordance with law.
Accordingly this writ petition stands disposed of.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
