Judgment
The petitioners are aggrieved by the in-action and deliberate administrative failure on the part of the 4th respondent/RDO in taking up, not hearing, and not passing any orders on Statutory Appeal No.____ of 2026 file by the petitioners on 22.07.2026 under Section 15 of the Telangana Bhu Bharathi (Record of Rights in Land) Act, 2025, along with its I.A.No.____ of 2026 (for condonation of delay under Section 5 of the Limitation Act, 1963) and I.A.No.____ of 2026 (seeking interim suspension of the operation of impugned Memo No.B/5937/07 dated 31.10.2007 and its consequential Memo No.B/3958/2017 dated 11.01.2018 issued by the 5th respondent/Thahsildar, Kodad as well as consequential revenue entries) and seeking a consequential direction to 4th respondent forthwith to take up and hear the Statutory Appeal filed by the petitioners on 22.07.2026 along with pending I.A.s with main Appeal, within a strict time bound period.
Learned counsel for the petitioners submits that an appeal was preferred against the impugned order dated 31.10.2007 passed by respondent No.5 and a consequential impugned memo dated 11.01.2018 issued by the Thahsildar, Kodad. It is submitted that the said appeal was filed on 22.07.2026, till date the appeal has not been decided as such seeks a direction to the Revenue Divisional Officer/respondent No.4 to decide the appeal in a time bound period.
Learned Assistant Government Pleader appearing for respondent authorities submits that to the extent of deciding the appeal, the same will be considered and appropriate orders would be passed strictly in accordance with law and prayed to pass appropriate orders.
Considering the submissions made by the learned counsel on either side and without going into the merits of the case, this writ petition is disposed of with consent directing the respondent No.4 to decide the appeal filed by the petitioners, after putting all the effected/interested parties on notice and upon enquiry, strictly in accordance with law, as expeditiously as possible, preferably within a period of twelve (12) weeks from the date of receipt of a copy of this order and communicate the order to the petitioners.
With these directions, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous applications, if any pending, shall stand closed.
