Judgment
This writ petition is filed seeking to declare the action of respondent Nos.2 to 4 in not issuing pattadar pass book to the petitioner for the land admeasuring Acs.7-30 guntas in Survey No.5/Aa and Acs.4-28 guntas in Survey No.13/Aa, total land admeasuring Acs.12-18 guntas, situated at Inamguda Village, Abdullapurmet Mandal, Ranga Reddy District (for short 'subject lands'), as being arbitrary and unconstitutional.
It is submitted that the petitioner is the absolute owner and possessor of the aforesaid subject lands which are his ancestral properties. The subject lands originally devolved upon the mother of the petitioner, Smt. Babburi Kamalamma. The mother of the petitioner died on 12.07.2022 and the petitioner, being the sole surviving legal heir, inherited the subject lands by intestate succession.
It is stated that respondent Nos.5 to 8, without having any right or entitlement, set up a false claim over the subject lands and filed a suit in O.S.No.143 of 2013 in the Court of the Junior Civil Judge, Hayathnagar, Ranga Reddy District (for short 'trial Court'), against the petitioner and his mother. The suit was contested. The trial Court, without appreciating the facts and circumstances, decreed the suit by judgment dated 30.06.2016. Aggrieved thereby, the petitioner and his mother preferred appeal being A.S.No.199 of 2016 on the file of the VIII Additional District Judge, Ranga Reddy District (for short 'appellate court'). By judgment dated 28.02.2017, the appeal was allowed and the judgment dated 30.06.2016 passed by the trial Court was set aside. Thereafter, respondent Nos.5 to 8 filed Second Appeal No.339 of 2017 challenging the judgment and decree dated 28.02.2017 passed by the appellate court. The second appeal was dismissed by order dated 18.11.2020. Subsequently, respondent Nos.5 to 8 filed Review I.A.No.1 of 2021 in S.A.No.339 of 2017. However, the Review I.A.No.1 of 2021 was dismissed by order dated 02.03.2022. Thereafter, challenging the judgment dated 18.11.2020 in S.A.No.339 of 2017 and the order dated 02.03.2022 in Review IA.No.1 of 2021 in S.A.No.339 of 2017, respondent Nos.5 to 8 preferred Special Leave Appeal (C) No(s).18208-18209 of 2022 before the Honourable Supreme Court of India, which were dismissed as withdrawn by order dated 31.10.2022.
The petitioner submitted online applications dated 16.03.2026 requesting the respondent authorities to implement the decree of the appellate court in A.S.No.199 of 2016, as affirmed by this Court in S.A.No.339 of 2017 and the Honourable Supreme Court in Special Leave Appeal (C) No(s).18208-18209 of 2022, and sought for issuance of pattadar pass book in respect of the subject lands, but the applications of the petitioner are so far not being considered.
Heard Mr. M.A.K. Mukheed, learned counsel for the petitioner, and Mr. L. Ravinder, learned Assistant Government Pleader for Revenue, appearing for respondent Nos.1 to 4.
Learned Assistant Government Pleader for Revenue submitted that online applications of the petitioner will be duly considered in accordance with law.
In view of the above, this writ petition is disposed of, directing respondent Nos.3 and 4 to consider the petitioner's online applications dated 16.03.2026, for mutation and issuance of pattadar pass book in respect of the land admeasuring Acs.7-30 guntas in Survey No.5/Aa and Acs.4-28 guntas in Survey No.13/Aa, total land admeasuring Acs.12-18 guntas, situated at Inamguda Village, Abdullapurmet Mandal, Ranga Reddy District, and pass orders in accordance with law, by issuing notice to the petitioner and respondent Nos.5 to 8 and by affording them an opportunity of personal hearing, within a period of forty-five (45) days from the date of receipt of a copy of this order. As this order is passed without entering into the merits of the case, notice to respondent Nos.5 to 8 is dispensed with. However, if respondent Nos.5 to 8 are aggrieved by this order, they are at liberty to seek modification of this order. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in this writ petition stand closed.
