This Contempt Petition is filed by the petitioner alleging breach and wilful disobedience of the order dated 05.04.2024 passed by this Tribunal in OA No. 358/2021.

This matter has been adjourned from time to time awaiting the decision of Writ Petition No. 18769/2024 pending before the Hon’ble High Court of Karnataka. Today, learned counsel for the petitioner would fairly submit that this Contempt Petition may be closed reserving liberty to the petitioner to seek revival of this Contempt Petition, depending upon the outcome of the pending Writ Petition No. 18769/2024.

Learned counsel appearing for the respondents also sought for closing the Contempt Petition with liberty on earlier occasions, more particularly, on the undertaking said to have been given before the Hon’ble High Court of Karnataka orally by the learned counsel appearing for the petitioner that this Contempt Petition shall not be precipitated.

Having regard to the pendency of the Writ Petition No. 18769/2024 and the submissions made by the learned counsel for the parties, we find it appropriate to close this Contempt Petition at present, reserving liberty to the petitioner to seek revival of this Contempt Petition depending on the outcome of the Writ Petition No. 18769/2024 pending before the Hon’ble High Court of Karnataka. Ordered accordingly.

Resultantly, Contempt proceedings are closed; Notices are discharged with liberty as aforesaid. No order as to costs.
