Judgment
The grievance in this letter petition sent by Mr. Rambeer resident of Village Bijrol, Tehsil Badot, District Bagpat, Uttar Pradesh is that Mr. Narender Pal Tomer is illegally running Kollu for making Gud (Jaggery Unit) in the above said village and he is burning plastic, rubber, old shoes, sleepers, clothes, tyers etc., in the Bhatti (furnace) for making Gud and thereby causing air pollution in the area.
On due consideration of the matter, we are of the view that the allegations made need factual verification and immediate remedial action. Accordingly we constitute and direct Joint Committee of representative of State PCB and District Magistrate, Bagpat to verify the factual position, look into the grievances of the applicant and take remedial action in accordance with law by following due process within one month from the date of receipt of a copy of this order. The Report must also refer to compliance with the guidelines of CPCB dated 13.08.2019 and CTO granted with reference to approved fuel.
Factual and action taken report may be furnished within two months by e-mail at judicial-ngt@gov.in preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF, before the Ld. Registrar General, National Green Tribunal, Principal Bench, New Delhi who may, if necessary, put up the matter before the Bench for further directions.
The application is disposed of with the above said directions.
A copy of this order, along with a copy of the complaint, be forwarded to the State PCB and District Magistrate, Bagpat by e-mail for compliance.
