This original application has been registered under Section 14& 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition dated 16.06.2022 received from Mukesh Kumar & Ors. alleging that adjacent to northern boundary of New R-block society, Dilshad Garden, there is a plot No. 43 Class A Dilshad Garden owned by one Jitendra Aggrawal wherein two borewells have been illegally installed/drilled for commercial utilization and ground water is being extracted for commercial use without permission from concerned authority in an illegal manner hence causing damage to environment.

In our view, the matter must be examined and looked into by the concerned authorities at their own level and therefore, we dispose of this original application directing DPCC and District Magistrate, Shahadra to visit the site, collect relevant information and if finds any violation, take appropriate remedial, preventive and punitive action in accordance with law within two months.

The application is disposed of accordingly.
