This Original Application has been registered under Section 14 & 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition dated 09.03.2023 sent by Kamlesh Jaiswal r/o A-14, Kamal Vihar, Burari, Delhi – 84.

It is said by the complainant that Gurwinder Singh s/o Darshan Singh, r/o B-300, Hari Nagar, Delhi has installed a borewell illegally for extraction of ground water for commercial use inasmuch as it has installed a water plant and supply illegally extracted ground water on commercial basis without any permission of the competent Authority i.e. CGWA and causing contamination of ground water and damage to environment.

In our view, this issue can be looked into, at the first instance, by the local authorities and for the purpose whereof we constitute a joint Committee comprising DPCC and DJB, who shall visit the site, collect relevant information and if finds any violation of environmental laws and norms, would take appropriate remedial and preventive action including assessment of compensation, if any, against the violators in accordance with law within two months.

With the above direction, the application is disposed of.
