This original application has been filed by a student appearing in 12th Board examination, residing in MCC Signature Homes, Raj Nagar Extension, Ghaziabad, Uttar Pradesh raising the grievance that unauthorized, illegal and perpetual noise pollution/nuisance is caused due to the high wattage sound amplifiers played in the marriage lawns/banquet namely Golden View Resort and Mount Green Farm/Resort situated just opposite to the colony. As per the allegation the loud music played, crosses the permissible noise limit and disrupts the local residence.

The allegation made in the OA raises substantial issue relating to compliance of environmental norms.

The issue needs to be duly looked into by the Member Secretary, Uttar Pradesh Pollution Control Board (UPPCB) by carrying out the spot inspection, ascertaining the level of noise pollution caused by the project proponent and also taking the appropriate remedial action.

Hence, we disposed of the OA directing the Member Secretary, UPPCB to take appropriate action to remediate the situation expeditiously and file action taken report before the Registrar General of the Tribunal within three months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF. If found necessary, the matter will be listed for consideration before the Tribunal.

A copy of this order, along with a copy of the petition, be forwarded to the Member Secretary, UPPCB by e-mail for compliance.
