Judgment
In this Original Application, the allegation is against respondent no. 7, Tulip Ivory that the said respondent is operating DG set, transformer and other machines 24x7 at a distance of just 2-3 mtrs. from the residence of the applicant and is causing the pollution in violation of Noise Pollution (Regulation and Control) Rules, 2000. Further allegation is that on account of operations of DG sets, transformer etc. by respondent no. 7, the noise level in the flat of the applicant is measured as 65 d(B) to 75 d(B) at all time, which is beyond the permissible limit and that the applicant and other residents of the area are facing the issue of pollution and that the noise pollution has created the health hazardous leading to tinnitus, headache, sleep discomfort etc.
Having regard to the issue which has been raised in the application, we are of the opinion that the said issue needs consideration by respondent no. 3, Haryana State Pollution Control Board.
Hence we dispose of the application with the direction to the Member Secretary, Haryana State Pollution Control Board to duly consider the grievance of the applicant and take remedial measures in accordance with law after giving due opportunity of hearing to respondent no. 7. The respondent no. 3 may complete the aforesaid exercise within three months and file an action taken report by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF before the Register General of the Tribunal, who if found necessary will place the same before the Court for consideration.
The Original Application is accordingly disposed of.
