Pradeep Yadav vs State of Uttar Pradesh

This Original Application is registered on the basis of the letter petition received from one Pradeep Yadav resident of Village Gola, Thana-Cholapur, district Varanasi with the grievance that adjoining to his village in the border of village Tewar-Baraichha there is a cardboard manufacturing unit which collects garbage from all over the city and processes it in the unit which emits strong smell making it difficult to the villagers to breathe. It is further alleged that after the processing, plastic and garbage which comes out is burnt which emits black smoke and creates health hazard. It is also the allegation that from the unit dirty water is discharged which gets collected in the nearby agricultural field and creates danger of dengue, malaria etc. The grievance is that though request to the unit was made and complaints to the authorities were forwarded but no action has been taken till now.

The letter petition raises substantial issue relating to compliance of the environmental norms.

Along with the letter petition, the complainant has also enclosed a copy of the complaint which was made to the Member Secretary, Uttar Pradesh Pollution Control Board (UPPCB).

We are of the view that since the complaint has already been made to the Member Secretary, UPPCB. Therefore, the Member Secretary, UPPCB should take appropriate action on the said complaint, should get the spot inspection done, collect the relevant information in respect of violation of environmental norms by the unit and take appropriate remedial action, if required.

Member  Secretary,  UPPCB  will  submit  the  action  taken  report within three months before the Registrar General of the Tribunal by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF and if found necessary the matter will be listed before the Bench for consideration.

OA is accordingly disposed of.

A copy of this order, along with a copy of the petition, be forwarded to the Member Secretary, UPPCB by e-mail for necessary action.
