Judgment
In this original application, the grievance of the Applicant is that Respondents No. 9 and 10 are operating industrial unit for manufacture of lock and key by the name of M/s. Laxmi Metals and Laxmi Udyog in the residential area at Aligarh, Uttar Pradesh and these industrial units are causing air, water and noise pollution. It is also the allegation of the Applicant that though the complaints were made by the Applicant to different authorities but no action has been taken.
During the course of argument, learned Counsel for the Applicant has referred to the communication sent by the Regional Officer, UPPCB to the Vice Chairman, Aligarh Development Authority containing the observations after the inspection of the units of above respondents wherein it had found that the unit was operating using power press and ret machine in the residential area in violation of the direction of the High Court. Submission of learned Counsel for the Applicant is that the units are not only using chimneys and emitting smoke therefrom, but they are also flowing acid like material in the drains.
We find that no comprehensive complaint has been made by the Applicant to any competent authority dealing with the environmental issues.
Hence, we dispose of the OA permitting the Applicant to file a detailed comprehensive complaint to the Member Secretary, UPPCB who, on receipt of the same, will duly look into the grievance of the Applicant and take appropriate remedial action in accordance with law and submit action taken report before the Registrar General of the Tribunal within three months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF. If found necessary, the matter will be listed for consideration before the Bench.
The OA is accordingly disposed of.
A copy of this order be forwarded to Member Secretary, UPPCB by e-mail for compliance.
