Judgment
This OA is registered on the basis of the letter petition received from one Islam resident of the Dari factory, Loni, Mohalla Toli, Ikram Nagar, Police Station – Loni, Ghaziabad. The complaint of the Applicant is that in the neighborhood of the Applicants house there is a Malik Marriage Home situated at Dari factory, Loni, Mohalla Toli, Loni Police Station, Ghaziabad and the said marriage home is operating illegally and throwing the dirty water and the waste in Rana Talab Road which is causing pollution and emitting the foul smell. It is also alleged that in the marriage home DJ is played till late night and crackers are busted. There is also allegation of noise pollution by use of heavy generators and air pollution by burning the plastic waste material on the road.
The OA raises substantial issue relating to the compliance of the environmental norms.
Such an issue needs to be first examined and considered by the Member Secretary, Uttar Pradesh Pollution Control Board (UPPCB).
Hence, we disposed of the OA directing the Member Secretary, UPPCB to get the spot inspection done and find out the correct status and extent of violation of environmental norms by the said marriage home and take appropriate remedial action.
Let an action taken report be submitted by the Member Secretary, UPPCB before the Registrar General of the Tribunal within three months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF and if found necessary the matter will be listed before the Bench for consideration.
OA is accordingly disposed of.
A copy of this order, along with a copy of the letter petition, be forwarded to the Member Secretary, UPPCB by e-mail for necessary action.
