Judgment
Heard Mr. Parimala Maligi, learned counsel for the petitioners, Mr. Midde Arun Kumar, learned standing counsel for GHMC, appearing for respondent No.3 and learned Assistant Government Pleader for Home appearing for respondent No.5.
Learned Assistant Government Pleader for Home placed on record written instructions and submitted that on receipt of complaint dated 10.01.2026 from petitioner No.1, respondent No.5 conducted detailed enquiry and found that grievance of the petitioner No.1 is related to alleged encroachments, unauthorized construction/ structures, use of common parking areas and passages by respondent No.6, and the same falls within the purview of the GHMC. After conducting detailed enquiry, respondent No.5 closed the complaint as Civil in Nature on 19.02.2026.
Learned standing counsel for GHMC submitted that complaint dated 08.01.2026 of the petitioners would be considered by respondent No.3 and pass appropriate orders in accordance with law.
Recording the aforesaid submission of learned standing counsel for GHMC, without going into the merits of the case, the writ petition is disposed of, directing respondent No.3 to consider the representation/complaint dated 08.01.2026 of the petitioners regarding illegal encroachments, unauthorized structures made by respondent No.6 under the name and style of “M/s. Wimpy Chinese Fast Food” situated on the ground floor of the property bearing H.No.5-9-215, Ground Floor, B-Block, “Sapphire Plaza”, Abids, Chirag Lane, Hyderabad, and pass orders, in accordance with law, by issuing notice to the petitioners, respondent Nos.6 and 7, and all other concerned interested persons, by affording opportunity of hearing to them, within a period of four (4) weeks from the date of receipt of a copy of this order.
As this order is passed without entering into merits of the case, notice to respondent Nos.6 and 7 is dispensed with. If respondent Nos.6 and 7 are in any way aggrieved by this order, they are liberty to approach this Court seeking modification of this order. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
