Judgment
4. Mohammed Mustafa Khan, S/o. Late Mohammed Lutfullah Khan, Aged about 81 years, Super Senior Citizen, Occ. Business, R/o. H.No. 8-2-334/10, Road No.3, Banjara Hills, Hyderabad.
Since both the writ petitions pertains to same property i.e., Municipal Nos.8-2-334/11, 8-2-334/11/1, 8-2-334/11/2 and 8-2- 334/11/3 and part of Municipal No.8-2-334 (old), Plot No.11 consisting of Ground, First and Second Floors, admeasuring 271.99 square yards situated at Road No.3 (Rear Side), Banjara Hills, Hyderabad, and the petitioner and unofficial respondent being the same, with the consent of the both sides, they are being disposed of by this common order.
For the sake of convenience the parties herein are referred to as arrayed in W.P. No.30451 of 2025.
Heard Mr. Pasham Krishna Reddy, learned counsel for the petitioner, Mr. Midde Arun Kumar, learned standing counsel for Greater Hyderabad Municipal Corporation (GHMC) appearing for respondent Nos.2 and 3 and Mr. Thomas George, learned counsel for respondent No.4.
Learned standing counsel for GHMC placed on record the letter addressed by respondent No.3 to the petitioner vide Roc.No.106/TPS/DC/CIR36/KZ/GHMC/2026 dated 11.08.2026 and photograph dated 11.08.2026 in proof of sealing of subject property. It is stated that show-cause notice dated 12.02.2026 was issued to the petitioner as he carried out unauthorized additions and alterations to the existing building of Ground + two (2) upper floors by erecting new columns in the setback area and laid extension slabs into setback area in the Ground + two (2) upper floors and also raised columns on third floor without any valid permission from the GHMC. After issuance of show-cause notice, the subject property was seized on 12.02.2026 to prevent further unauthorized construction and misuse of premises.
It is stated that the GHMC came to know that the petitioner has unlawfully removed the seal affixed by the GHMC and on noticing the same. The subject property was re-sealed and in proof the same, learned standing counsel produced photograph dated 11.08.2026 indicating location and time.
Learned counsel for respondent No.4 submitted that building of the petitioner has been re-sealed as of now.
Learned standing counsel submitted that in view of resealing of subject property, the cause in these writ petitions do not survive requiring any further adjudication and requested this Court to close the writ petitions. It is stated that further action including demolition of subject property will be taken in accordance with law.
Learned counsel for respondent No.4 submitted that liberty may be granted to respondent No.4 to seek modification of order or file fresh writ petition if petitioner again undertakes unauthorized construction by removing the seals.
In the light of above submissions, these writ petitions are disposed of granting liberty to respondent No.4 - Mr. Mohammed Mustafa Khan, as prayed for. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petitions stand closed.
