Heard Mr. Jalli Kanakaiah, learned senior counsel, appearing for Mr. Jalli Narender, learned counsel for the petitioner and Mr. Laxmaiah Kanchani, learned standing counsel for Cyberabad Municipal Corporation (CMC), appearing for respondent Nos.2 and 3.

Show-cause notice dated 22.08.2026 was issued to the petitioner stating that petitioner constructed building in the Plot No.26 (Western Part) in Survey Nos.8, 10 and 13 situated at Krishna Reddy Enclave, Neknampur Village, Gandipet Mandal, Ranga Reddy District, in deviation of the sanctioned plan. Petitioner constructed additional 3rd, 4th floors and centring for 5th floor against the sanctioned plan of Stilt + two (2) upper floors.

Learned senior counsel submitted that pursuant to the show-cause notice dated 22.08.2026, petitioner submitted reply dated 11.09.2026 stating that he is willing to file regularization application under Sections 455-A and 455-AA of the Greater Hyderabad Municipal Corporation Act 1955 (GHMC Act). However, even before reply is submitted the petitioner, building has been sealed.

Learned standing counsel for CMC submitted that in compliance of the general directions issued by this Court by order dated 29.04.2025 in W.P. No.12889 of 2025, building has been sealed by Municipal authorities, as the petitioner was proceeding with unauthorized construction of 3rd, 4th and 5th floors on the subject property.

Learned standing counsel for CMC submitted that this Court disposed of W.P. No.18424 of 2026 by order dated 17.06.2026 by imposing costs on the petitioner therein and prayed to grant similar order by imposing reasonable costs on the petitioner herein.

In view of the above submissions, the writ petition is disposed of, directing respondent Nos.2 and 3 to unseal the Stilt + two (2) upper floors of the subject property. However, the sealing on unauthorized 3rd, 4th and 5th floor shall continue. Further, petitioner shall submit application seeking regularization of unauthorized structures made on the Plot No.26 (Western Part) in Survey Nos.8, 10 and 13 situated at Krishna Reddy Enclave, Neknampur Village, Gandipet Mandal, Ranga Reddy District, within a period of ten (10) days from the date of receipt of a copy of this order. On receipt of such application, respondent Nos.2 and 3, as the case may be, are directed to consider the same, and pass orders, in accordance with law, within a period of four (4) weeks thereof, subject to the condition of the petitioner depositing costs of Rs.3,00,000/- (Rupees three lakhs only) to the Cyberabad Municipal Corporation (CMC) within a period of two (2) weeks from the date of receipt of a copy of this order.

Pending consideration of the regularization application submitted by the petitioner, status quo, obtaining as on today, shall be maintained in respect of the structures standing on the subject property. a sequel thereto, miscellaneous applications, if any, the writ petition stand closed.
