Judgment
Heard learned counsel for the petitioners and Mr. G. Madhusudhan Reddy, learned standing counsel for GHMC, appearing for respondent Nos.2 to 4.
Learned standing counsel for GHMC submitted that petitioners were granted building permission vide Lr.No.384223/GHMC/5236/2024 dated 06.04.2024 for construction of Stilt for parking + two (2) upper floors, as against the same, petitioners constructed Stilt + five (5) upper floors. Hence, petitioners are not entitled for any relief.
Learned counsel for the petitioners submitted that petitioners submitted application dated 03.06.2026 under Sections 455-A and 455-AA of the Greater Hyderabad Municipal Corporation Act 1955 (GHMC Act) seeking regularization of unauthorized construction made on the subject property.
Learned counsel further submitted that in similar circumstances this Court disposed of W.P. No.18424 of 2026 by order dated 17.06.2026 by imposing costs and further direction be given to respondent authorities to consider regularization application dated 03.06.2026.
Recording the submissions of both the learned counsel, the writ petition is disposed of, directing respondent No.2 to consider the regularization application dated 03.06.2026 of the petitioners submitted under Sections 455-A and 455-AA of the GHMC Act in respect of the property bearing Municipal No.3-2-27 admeasuring 208 square yards situated at Kachiguda, Hyderabad, and pass orders, in accordance with law, by issuing notice to the petitioners, and all other concerned/interested persons, by affording opportunity of hearing to them, subject to the condition of petitioners paying costs of Rs.3,00,000/- (Rupees three lakhs only) i.e., (i) Rs.2,00,000/- (Rupees two lakhs only) to the Greater Hyderabad Municipal Corporation; (ii) Rs.1,00,000/- (Rupees one lakh only) to the Telangana High Court Advocates Association (THCAA), within a period of two (2) weeks from the date of receipt of a copy of this order.
Pending consideration of the regularization application of the petitioners dated 03.06.2026, status quo, obtaining as on today shall be maintained in respect of the structures standing on the subject property.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
