Heard Mr. C. Viswanath, learned counsel for the petitioners; and Mr. Raparthi Venkatesh, learned Standing Counsel for GHMC appearing for respondent Nos.3 to 5; and perused the material on record.

The learned Standing Counsel for GHMC submitted that building of the petitioners was sealed for making unauthorised construction. Subsequently, the petitioners submitted representation dated 16.07.2026 to respondent No.2 - GHMC seeking permission to rectify deviations made in the building construction.

The learned counsel for the petitioners submitted that permission was granted to the petitioners for construction of stilt + four (4) upper floors in Plot Nos.74 and 75 in Survey No.41/Part, Parama Reddy Hills, Upperpally Village, Rajendranagar Mandal, Ranga Reddy District. As against the same, the petitioners constructed cellar + three (3) upper floors. However, there are some minor deviations which are within the permissible limits. The petitioners would rectify the deviations or in alternative get the deviations regularized under Sections 455-A and 455-AA of the GHMC Act. It is stated that apart from representation dated 16.07.2025, the petitioners have also submitted the application dated 27.04.2026 for regularisation of the subject structures / deviations under Sections 455-A and 455-AA of the GHMC Act by paying a requisite fees of Rs.10,000/- (Rupees ten thousand only).

The learned Standing Counsel for GHMC submitted that as held by this Court in W.P. No.18424 of 2026 dated 17.06.2026, the petitioners are liable to pay costs, if they seek for an order to consider their regularisation application. In response, the learned counsel for the petitioners submitted that reasonable costs may be imposed.

In the circumstances, respondent No.5 the Assistant City Planner, Attapur-Circle 20, is directed to forthwith unseal the subject property i.e., stilt + four (4) upper floors in Plot Nos.74 and 75 in Survey No.41/Part, Parama Reddy Hills, Upperpally Village, Rajendranagar Mandal, Ranga Reddy District, so as to enable the petitioners to rectify the deviations or seek regularization pursuant to their representations dated 16.07.2025 and 27.04.2026 subject to payment of following costs within a period of two (2) weeks from the date of receipt of a copy of this order :

(a)

Rs.70,000/- (Rupees seventy thousand only) to the GHMC, Hyderabad, who shall maintain a separate account and utilize the amount for providing health benefits to the Class-IV employees like scavengers, sanitary workers, sweepers etc., who are appointed on contractual or outsourcing basis, and

(b)

Rs.30,000/- (Rupees thirty thousand only) to the Telangana High Court Advocates Association, Hyderabad, who shall maintain a separate account under the Head “Young Advocates Welfare Fund” and utilize the amount by framing guidelines for the benefit of young Advocates having standing of less than seven (07) years.

The petitioners shall take necessary steps for rectifying / regularisation of the subject structures / deviations, as directed above. Accordingly, the writ petition is disposed of, at the admission stage itself.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
