Learned counsel appearing for the applicant seeks permission to withdraw the application.
The applicant had earlier filed an application under Section 14 of the National Green Tribunal Act, which on the face of it was not maintainable. At the time of arguments, the learned counsel appearing for the applicant sought permission to withdraw the application with liberty to institute fresh application. Permission was granted and the application was dismissed as withdrawn with liberty to file proper application.
This is the second application. On going through the application, we find no pleading to invoke Section 14 of the National Green Tribunal Act and no materials are placed to entertain the application. The applicant therefore seeks permission to withdraw the application with liberty to file a fresh one.
When the liberty was granted to withdraw the application with liberty to institute a fresh application and inspite of the liberty granted no proper application is filed, it is not in the interest of justice to provide further opportunity institute fresh application to the applicant
Therefore, the application is dismissed as withdrawn. No order as to costs.
