Judgment
The applicant has filed the present application under the provisions of National Green Tribunal Act, 2010 complaining about cutting of trees from and making unauthorized road on the area of green belt in HSVP Sector 24 of Panipat, Haryana.
The application filed by the applicant is vague and lacks requisite details (i) regarding number of trees illegally cut, (ii) area of green belt encroached upon, (iii) persons who have illegally cut the trees, (iv) persons who have encroached upon the area of the green belt and (v) the structures existing over the green belt etc. and the applicant has merely impleaded MoEF&CC as respondent no. 1 and has not impleaded the Administrator, HSVP and the Deputy Commissioner, Panipat and the persons who are alleged to have made the encroachments.
The applicants seeks permission to withdraw the present application with liberty to file fresh application on the same cause of action with requisite details/better particulars and by impleading the necessary parties.
Accordingly, the present application is dismissed as withdraw, with liberty as aforesaid.
