Application is registered based on a complaint received by Post.
ORDER
Mr. Mahendra Mishra resident of 352-A Rail Bazaar Cantonment, Kanpur has sent the present letter petition complaining about air pollution caused by smoke and poisonous gases emitted from the furnaces and metal foundries working in the area of Thathera Patti, Lohar Fatak and Harisganj, Rail Bazaar Cantonment, Kanpur. The applicant has prayed that after making due inquiry the same be ordered to be closed.
We find that the complaint is general and vague in nature. The applicant has neither impleaded any of the polluters nor given any details of the polluting industries.
While there has to be strict implementation of the environmental norms, rules and regulations and all requisite steps have to be taken for protecting and improving environment and abating environmental pollution, yet grievances of the applicant can be redressed only when the requisite details of polluters and polluting industries are given so that they can be heard by this Tribunal before passing any closure order against them as prayed for.
However, if the applicant gives the requisite details of the polluters/polluting industries, State PCB, Commissioner, Kanpur Municipal Corporation and District Magistrate, Kanpur may look into the matter and take remedial action in accordance with law.
The application is disposed of accordingly.
