Application is registered based on a complaint received by e-mail
This original application has been registered under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) pursuant to a letter petition dated 01.06.2022 sent by Shri Hari Prakash, Advocate, Civil Court, Najibabad, Bijnor, Uttar Pradesh. The basic complaint made by said complainant is that there is illegal construction of a boundary wall on Government land and this encroachment has been made by Yogesh Pal S/o Late Lal Singh Pal, Khempal alia Sukhhe S/o Late Genda Singh Pal resident of Mohalla Makbara, Rana Pal S/o Late Raghuvir Singh Pal resident of Subhash Nagar, Bundki Road, Najibabad, Mahender Singh Pal S/o Late Ram Singh Pal resident of Mohalla Gadariyan.
The dispute is, in fact, relating to encroachment of Government land and unauthorized construction which does not give rise to any substantial question relating to environment for implementation of the scheduled enactments under NGT Act, 2010 and the complaint made is beyond jurisdiction of this Tribunal under NGT Act, 2010.
Application therefore is rejected as not maintainable.
