Judgment
Heard Mr. Rama Kotaiah Kandala, learned counsel for the petitioners and Mr. R. Sameer Ahmed, learned standing counsel for HYDRAA, appearing for respondent No.2.
Learned standing counsel for HYDRAA placed on record written instructions and submitted that on 18.03.2024, Full Tank Level (FTL) and buffer zone of Errakunta Lake have been fixed by the Deputy Inspector and rejuvenation work is taking place solely in Survey No.134. HYDRAA has not interfered with the plot of the petitioner forming pat of Survey Nos.48 and 49 of Bachupally Village.
Learned standing counsel also furnished copy of letter dated 04.07.2024 addressed by the Executive Engineer, Irrigation and Command Area Development, Irrigation Division No.1, Hyderabad, to the Metropolitan Commissioner, HMDA, whereby, Executive Engineer, requested the Commissioner, HMDA, to revoke permissions accorded to M/s. Maps Infra. represented by its Managing Partner, Mr. P. Sudhakar Reddy and other constructions falling in Survey No.134, and falling within the FTL and buffer zone of Errakunta Lake.
In view of the above submissions, without entering into the merits of the case, the writ petition is disposed of, directing respondent No.2 not to interfere with the peaceful possession and enjoyment of petitioner over the property bearing Plot No.844 admeasuring 144 square yards in Survey Nos.48 and 49 situated at Bachupally Village, Pragati Nagar, Nizampet Municipality, Medchal-Malkajgiri District, without following due process of law. However, this order shall not come in the way of respondent authorities in undertaking lake rejuvenation/restoration works in Survey No.134 of Bachupally Village covered by FTL/buffer zone. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
