ORDER: (ORAL)

This writ petition is filed questioning the action of respondent Nos. 2 to 4 in interfering with the petitioners' peaceful possession and enjoyment of the subject Plot Nos. 111 (part) and 116 (part), each admeasuring 200 square yards, in Survey No. 882, situated at Medchal Village and Mandal, Medchal-Malkajgiri District, and in threatening to dispossess the petitioners from the subject property, besides threatening to demolish the compound walls of the subject plots without issuing any notice.

Heard Mr. D. Kiran Kumar, learned counsel for the petitioners, and Mr. R. Sameer Ahmed, learned Standing Counsel for HYDRAA, appearing for respondent No.2.

As per written instructions of the learned Standing Counsel for respondent No.2, HYDRAA had been protecting the open spaces from encroachment in discharge of its duty; routine inspection of the layout of Sai Sree Nilaya Welfare Society, Medchal, was conducted on 30.06.2026; during inspection, it was found that open spaces earmarked in the Gram Panchayat approved layout of Sai Sree Nilaya Welfare Society in Plot Nos.111 and 116, admeasuring 200 square yards each, are vacant and unprotected, rendering vulnerable encroachment.

Learned Standing Counsel for respondent No.2 submitted that Plot Nos.111 and 116 (subject plots) have been earmarked as open spaces and the petitioners do not have any claim over the subject plots.

The grievance of the petitioners is that interference of HYDRAA in respect of subject plots is without following due process of law and the compound wall made by them has been demolished.

In the circumstances, the writ petition is disposed of, directing both parties to maintain status quo in respect of subject Plot Nos.111 and 116, each admeasuring 200 square yards, in Survey No.882 situated at Medchal Village and Mandal, Medchal-Malkajgiri District, until proper enquiry is conducted by respondent Nos.2 and 4, by issuing prior notice to the petitioners, and a decision is taken thereon. This order shall not come in the way of respondent Nos.2 and 5 in taking action against the petitioners by following due process of law and by affording an opportunity of hearing to the petitioners and Sri Sree Nilaya Welfare Society/interested persons. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
