Judgment
Heard Mr. Shresth Agarwal, learned counsel for the petitioner; learned Assistant Government Pleader for Municipal Administration and Urban Development, appearing for respondent No.1; Mr. Putta Krishna Reddy, learned Standing Counsel for Cyberabad Municipal Corporation, appearing for respondent Nos.2 and 3; and perused the material on record.
Learned counsel for the petitioner submitted that the impugned action of respondent authorities in sealing the property bearing H.No.1-60/30/9/E situated at Kondapur Village, Serilingampally Mandal, Ranga Reddy District is unwarranted and arbitrary. The property was constructed 15 years back. The petitioner received impugned notice dated 01.09.2026 vide Notice No.1-60/30/9/E/UC/TPS/W230/C50/KPZ/2026 on 08.09.2026. Though seven days' time was granted to the petitioner to submit an explanation to the show-cause notice, the same was served on 08.09.2026. Therefore, the petitioner may be granted reasonable time to submit explanation to the show-cause notice. It is further submitted that sealing of the property is not warranted as the structures raised by the petitioner are not of recent origin and have been in existence from the past 15 years.
Learned Standing Counsel for respondent Nos.2 and 3 submitted that show-cause notice dated 01.09.2026 was issued to the petitioner but so far, no reply has been submitted.
In the light of the contention of the learned counsel for the petitioner that the structures made in the subject property are in existence for more than 15 years, the writ petition is disposed of directing respondent No.3 not to seal the property. However, petitioner is directed to submit explanation to the show-cause notice No.1-60/30/9/E/UC/TPS/W230/C50/KPZ/2026 dated 01.09.2026 within a period of seven (07) days from today. Upon receipt of the said explanation, respondent No.3 shall consider the same and pass appropriate orders in accordance with law by affording opportunity of hearing to the petitioner. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition, stand closed.
