Judgment
Application is registered based on a letter petition received by post.
The grievance in the present application is regarding running of stone chips loading unit at Dhumka Railway Station in violation of environmental norms thereby causing environmental pollution and posing serious health hazards to the inhabitants.
Vide order dated 05.05.2022, this Tribunal constituted a Joint Committee with direction to submit its Factual and Action Taken Report within two months.
In compliance thereof, Factual and Action Taken Report was submitted vide email dated 13.09.2022.
Vide order dated 15.09.2022, this Tribunal impleaded respondents no. 1 to 4 and ordered issuance of notices to the respondents. Pursuant thereto reply has been filed by respondent no. 2-General Manager, Eastern Railway vide email dated 24.11.2022.
It has been pointed out that the matter has been dealt with by Special Bench of this Tribunal in O.A No. 19/2021 (EZ) titled as Ravi Shankar Mandal Vs. Union of India & Ors. which was disposed of vide order dated 27.02.2023 whereby detailed directions have been issued.
In view of the above, no further order is necessary in the present application which will abide by the order already passed by Special Bench of this Tribunal in the above said original application and the present application stands disposed of accordingly.
