Judgment
This original application has been registered on the basis of a letter petition dated April 2023 received from inhabitants of Village Govindsar and adjoining area through one Ashok Sharma.
The grievance raised in the letter petition is that for last few decades immense pollution is being caused due to loading and unloading of cement from Kathua Railway Station.
It is stated that though the nearby residents are protesting yet the concerned department has constructed a parallel line for loading/unloading operations at Kathua which will exaggerate the problem of health hazard to local residents. It is stated that quantum of pollution due to fairies of trucks is huge and which produces smoggy cloud for hours over the village and is affecting the health of the residents who are now suffering from various types of allegories and respiratory ailments. It is also alleged that hundreds of new born, particularly of Govindsar, are born cripple and many children have congenital deformities.
A perusal the letter petition reveals that substantial issue relating to environment is involved. Hence, at this stage, we deem it proper to constitute a committee comprising of the Representative of the Secretary, Central Pollution Control Board; Representative of General Manager, Northern Railway; Member Secretary, J&K Pollution Control Committee and the District Magistrate, Kathua. The District Magistrate, Kathua will act as a nodal agency. The committee will get the site inspection report, ascertain the truthfulness of the allegation and the extent of pollution being caused in the area concerned on account of the alleged loading and unloading of cement from Kathua Railway Station.
The committee will submit the report before the General Manager, Northern Railway within a period of three months and the General Manager, Northern Railway will take appropriate decision and action on the said report within period of one month from the date of receipt of the report . The General Manager, Northern Railway will submit the action taken report before the Registrar General of the Tribunal within a period of five months by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF. If found necessary, the matter will be listed before the Bench for consideration.
The original application is accordingly disposed of.
