Judgment
The grievance in this present letter petition sent by Mr. Narender Kumar Sharma and other residents of Wards No. 3 & 8 behind Co-operative Bank, Nagar Panchayat, Parikshitgarh, Meerut is regarding illegal commercial activities of loading/unloading of sand and Rodi etc., carried on by Mr. Deepak in the residential area of Ward Nos. 3 & 8, behind Co-operative Bank, Nagar Panchayat, Parikshitgarh, Meerut and use of heavy transport vehicles for the purpose and thereby causing of air pollution posing serious health hazards to the inhabitants.
Vide order dated 20.05.2022, this Tribunal constituted a Joint Committee comprising of the State PCB, Executive Officer, Nagar Panchayat, Parikshitgarh, Meerut and District Magistrate, Meerut and directed the same to submit Factual and Action taken Report within three months. The relevant part of the order is reproduced below:
“The allegations made require due verification and immediate remedial action. Accordingly, we constitute a Joint Committee of the State PCB, Executive Officer, Nagar Panchayat, Parikshitgarh, Meerut and District Magistrate, Meerut and direct the Joint Committee to meet within four weeks and undertake site visits, look into the grievances of the applicant and take requisite action by following due process of law. The State PCB will be the Nodal agency for coordination and compliance. Factual and action taken report may be furnished within three months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF…”
In compliance thereof, the Joint Committee visited the site on 23. 06.2022 and has submitted report vide letter dated 16.08.2022 which has been forwarded by Regional Officer, UPPCB, Meerut to this Tribunal through E-mail on 16.08.2022. The relevant part of the report reads as under:-
“In the matter of Mr. Narendra Kumar Sharma and other residents it to be submitted that a complaint dated 17-03-2022 was received to the office of E.O. Nagar panchayat, Parikshitgarh Meerut against M/s Deepak Traders regarding commercial activates of loading/unloading of sand and Rodi etc. and use of heavy transport vehicles for the purpose and thereby causing of air pollution.
A notice vide letter no-129/N.P. Pari.Garh/Notice/ Meerut 2021-22 dated 23-03-2022 was issued to M/s Deepak Traders, but M/s Deepak traders have not stopped the activities, A letter no. 425/N.P.Pari.Garh/Meerut/2022-23 dated 22-06-2022 was issued to Thana incharge, Thana, Parikshitgarh Meerut for providing police force.
On dated 12-07-2022 M/s Deepak Traders has vacated the area on which earlier sand, rodi etc. activities were carried out. Presently, at the spot no storage of sand, rodi etc. was found stored. The spot was found vacated, at time of inspection photographs were taken which is a annexed.”
None has appeared on behalf of the applicants to dispute correctness of the observations made in the report of the Joint Committee.
In view of the report that M/s Deepak Traders has vacated the area on which earlier sand, rodi etc. activities were carried out, no further action is required to be taken on the present application which is disposed of accordingly.
