Judgment
Heard learned counsels for petitioner and for State.
The petitioner is apprehending his arrest in connection with Argora P.S. Case No.117 of 2026, for offence registered under section 316(2), 318(4), 338, 336(3), 340(2), 351, 352 and 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate-XIII, Ranchi.
Learned counsel for petitioner submits that the petitioner happened to be mother of Priyanshu Vaibhav and said Priyanshu Vaibhav and informant were in business terms and they were taking contract of event management. He next submits that the allegations are there against Priyanshu Vaibhav of requesting the informant to take the tickets of the celebrities from the credit card. He next submits that the dispute is there between the son of this petitioner and the informant, however, the mother has also been made accused. He also submits that the petitioner is a house-wife and having no criminal antecedent as disclosed in paragraph no.18 of the petition.
Learned State counsel opposes prayer and submits that the petitioner is the mother of Priyanshu Vaibhav.
On perusal of the FIR, it transpires that Priyanshu Vaibhav has requested the informant to take tickets of the celebrity from the credit card and the petitioner is mother of Priyanshu Vaibhav and it has been pointed out that she is house-wife having no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner.
Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of her surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate-XIII, Ranchi, in connection with Argora P.S. Case No.117 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
