The petitioner is apprehending his arrest in connection with Bokaro Steel City PS Case No.87 of 2026, for offence registered under section 308(2), 308(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Bokaro.

Learned counsel for petitioner submits that the petitioner has been falsely implicated in this case and the allegations of taking ornaments by way of threatening the son of the informant is there against Md.Saif. He next submits that false allegations are made of selling the ornaments of the informant in connivance with the petitioner. He submits that in view of the above fact there is direct allegation against Md. Saif and thus, the ingredients of sections 308(2) and 308(5) of BNS, 2023 are not made out against the petitioner. He also submits that the petitioner is having one criminal antecedent, however, that was due to road raging and that has occurred while taking over-take.

Learned State counsel opposes prayer and submits that the petitioner is named in the FIR and allegations are there of connivance in selling the ornaments and in view of that anticipatory bail may kindly be rejected.

On perusal of the FIR, it transpires that the allegations are there against Md. Saif of taking the ornaments from the house of the informant by way of threatening the son of the informant and that allegation is not there against the petitioner and only allegation is made that the petitioner in connivance with Md. Saif has sold the ornaments and one criminal antecedent is there against the petitioner and that is of different nature, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Bokaro, in connection with Bokaro Steel City PS Case No.87 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
