Heard learned counsels for petitioner and for State.

The petitioner is apprehending his arrest in connection with Jharia PS Case No.73 of 2026, for offence registered under section 303(2), 317(2) of BNS, 2023, pending in court of learned Additional Chief Judicial Magistrate, Dhanbad.

Learned counsel for petitioner submits that the name of the petitioner has come on confessional statement and the petitioner is having a shop of scrap articles. He next submits that the allegations are made that apprehended co-accused has sold the cable to the petitioner and the same was shown as scrap and in view of that, he has purchased the said cable.

Learned State counsel opposes prayer and submits that allegations are there of purchasing the said cable.

Considering that the petitioner is having scrap shop and he has purchased the said cable from the apprehended co-accused, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Additional Chief Judicial Magistrate, Dhanbad, in connection with Jharia PS Case No.73 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
