2/06.08.2026 Heard learned counsels for petitioner and for State.

The petitioner is apprehending his arrest in connection with Garhwa PS Case No.268 of 2026, for offence registered under section 126(2), 115(2), 117(2), 109(1), 351(2) and 352, 3/5 of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Garhwa.

Learned counsel for petitioner submits that the petitioner has nothing to do with the alleged allegation of throatling the neck.

She next submits that even the petitioner is not named in the FIR and the compromise has been taken place by way of Annexure-2 between the petitioner and the informant and on these grounds, she submits that anticipatory bail may kindly be granted.

Learned State counsel opposes prayer and submits that the allegations are there of throatling the neck.

Considering that the petitioner is not named in the FIR and the allegations of throatling the neck is there against one Laddu Khan and the compromise has been reached between the petitioner and the informant, and in the attending facts and circumstances of the instant case, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa PS Case No.268 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
