Judgment
2/05.08.2026 Heard learned counsels for petitioner and for State.
The petitioner is apprehending his arrest in connection with Lohsinghna PS Case No.61 of 2023, for offence registered under section 147, 148, 341, 323, 379, 307, 324, 504, 506, 149 of the IPC, pending in court of learned A.C.J.M., Hazaribagh.
Learned counsel for petitioner submits that allegations are made that when there was no place to over-take by the informant, altercation took place. He next submits that the allegation of assault and snatching of money is there against Krishna Mahto and Bablu Ram. He also submits that the petitioner is having no criminal antecedent as disclosed in paragraph no.12 of the petition.
Learned State counsel opposes prayer and submits that allegations are there of assault by fists against this petitioner.
On perusal of the FIR, it transpires that only allegation is made against the petitioner of assault by fists and the allegations of snatching of Rs.2,000/- is there against Krishna Mahto and assault by hard and blunt substance against one Bablu Ram and the petitioner is having no criminal as aforesaid, I am inclined to grant anticipatory bail to petitioner.
Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned A.C.J.M., Hazaribagh, in connection with Lohsinghna PS Case No.61 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
