Judgment
2/05.08.2026 Heard learned counsels for petitioners and for State.
The petitioners are apprehending their arrest in connection with Keredari PS Case No.263 of 2023, for offence registered under section 341, 323, 307, 325, 448, 504, 506, 427, 34 IPC, pending in court of learned Judicial Magistrate First Class, Hazaribagh.
Learned counsel for petitioners submits that there are case and counter case between the parties. He further submits that earlier father of the petitioners has lodged the case being Keredari PS Case No.262 of 2023 and the altercation took place between both the sides due to keeping the stones on the road and for that case and counter case between the parties are there and there are general and omnibus allegations. He next submits that the police has investigated the matter and submitted the charge sheet under the bailable sections of the IPC however differing with the charge sheet the learned court has been pleased to take cognizance under section 307 of the IPC and the petitioners are having no criminal antecedent as disclosed in paragraph no.12 of the petition.
Learned State counsel opposes prayer and submits that allegations are there of assault.
Considering that there are case and counter case between the parties and differing with the charge sheet the learned court has been pleased to take cognizance under section 307 of the IPC and further the petitioners are having no criminal antecedent as disclosed in paragraph no.12 of the petition, I am inclined to grant anticipatory bail to petitioners.
Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Hazaribagh, in connection with Keredari PS Case No.263 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
