Judgment
Heard Mr. P. Ramprasad, learned counsel for the petitioner and Mr. K. Laxmaiah, learned standing counsel for respondents No.2 to 4.
Learned counsel for the petitioner submitted that without prior notice and without referring to the provisions of the Greater Hyderabad Municipal Corporation Act, 1955, the respondent authorities have partly demolished the structures of the petitioner in property bearing H.No.3-27/208/E/2/A/1, Sy.No.208/UU/2, Gandipet Mandal, Cyberabad, Ranga Reddy District. The petitioner is the owner of the property by virtue of pattadar passbook bearing No.T05070070006.
Learned standing counsel submitted that encroachment was noticed by the Cyberabad Municipal Corporation officials on the public road and structures were removed. However, learned standing counsel submitted that due process of law will be followed if any action is to be taken against the petitioner.
Recording the above submission, the writ petition is disposed of with a direction to the respondents No.3 and 4 not to interfere with the possession and enjoyment of the petitioner over property bearing H.No.3-27/208/E/2/A/1, Sy.No.208/UU/2, Puppalaguda, Gandipet Mandal, Cyberabad, Ranga Reddy District, without following due process of law.
The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
