Heard learned counsel for the petitioner and Mr. K. Ravi Mahender, learned standing counsel for the respondents No.2 to 4 – Cyberabad Municipal Corporation(CMC).

Learned standing counsel furnished written instructions and submitted that the petitioner raised illegal commercial shops on the road margin in front of Trendz Aspire Building as well as S R Digital School Building, located at Plot No.247, Guttala Begumpet, Kavuri Hills, Madhapur, Hyderabad. On complaint lodged by the residents regarding illegal encroachment on the road, action is being initiated.

Learned standing counsel further submitted that the designated road width is 40 feet; it is a link road to the nearby colonies; the width of the road is now reduced to 20 feet and has become a bottle neck due to widespread line of visual obstructions, causing inconvenience to the students, parents, pedestrians etc. The footpath is also is blocked and the same is posing serious threat to the safety of school children.

However, as seen from the photographs, Ex.P8, there are structures standing on the subject property.

In view of the same, the writ petition is disposed of with a direction to the respondent authorities not to interfere with the possession and structures raised at H.No.2016/1 (Part), Gramakhantham, admeasuring 98 sq. yards, Guttala Begumpet Village, Madhaour, Serlingampally Mandal, Ranga Reddy District, without following due process of law. The respondents are at liberty to take action against the petitioner by issuing prior notice and following the guidelines issued by the Supreme Court in IN RE: DIRECTIONS IN THE MATTER OF DEMOLITION OF STRUCTURES

The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
