Judgment
Heard Mr. Katika Ravinder Reddy, learned counsel for the petitioner and Mr. K. Ravi Mahender, learned standing counsel for respondents – Cyberabad Municipal Corporation (CMC).
Learned standing counsel for CMC submitted that the petitioner encroached upon the existing 60 feet road, abutting his property, which is proposed to be widened to 80 feet as per Master Plan. During the encroachment drive, GHMC demolished the unauthorized construction falling within the road area and there is no interference in the possession of the petitioner in respect of the subject property as alleged in the writ petition.
Learned counsel for the petitioner submitted that the property in possession of the petitioner admeasures 210 sq. yards bearing Municipal No.198/4/14, Sy.No.72, Madhapur Village, Serilingampally Mandal, Ranga Reddy District and the petitioner may be permitted to undertake repairs to the property.
It is made clear that the petitioner is entitled to proceed with repairs over the subject property without encroaching upon the public road. The GHMC is at liberty to take action against the petitioner by following due process of law.
With the above observations, the writ petition is disposed of.
The miscellaneous applications, pending if any, shall stand closed.
There shall be no order as to costs.
