Heard Ms. Ayesha Humera, learned counsel for the petitioners and Mr. K. Ravi Mahender, learned standing counsel for Cyberabad Municipal Corporation (CMC), appearing for respondent Nos.2 to 4.

Learned counsel for the petitioners submitted that petitioner No.1 is the tenant and petitioner No.2 is the owner of the subject property. Petitioner No.1 raised temporary structures (under Ex.P7) and is running in Steel trading in the subject property.

It is submitted that attempts are being made by respondent authorities to demolish the structures and dispossess the petitioners from the subject property without following due process of law.

As seen from the photographs under Ex.P7. structures are existing on the subject property. Hence, the writ petition is disposed of, directing respondent Nos.2 to 4 not to interfere with the peaceful possession and enjoyment of the petitioners over the property bearing Plot No.1340 admeasuring 300 square yards in Survey Nos.78 to 93 situated at Raja Rajeshwara Nagar Colony, Kondapur Village, Serilingampally Mandal, Ranga Reddy District, without following due process of law. However, respondent No.4 is at liberty to take action against the petitioners if any unauthorized construction is made by the petitioners by issuing notice and resorting to the provisions of the Greater Hyderabad Municipal Corporation Act 1955. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
