Amit Sharma vs Haryana Pond & Waste Water Management Authority & Ors

In this Original Application, the plea of the applicant is that in village Dhaliawas, there is a pond located at the entrance near the bypass road and eastern edge of the pond used to be a primary source of drinking water for the natives of the village and the pond was also used for the performance of religious rituals. The allegation of the applicant is that the water of the pond has become so contaminated that it cannot be used for any purpose. Further, allegation is that human waste, household and sewage dumps, effluents and bio wastage is flowing into the pond and contaminating the water. It is alleged that all drains and sewage of the village Dhaliawas are released into the pond through the adjoining man-made sewage line and solid and bio waste is also directly being dumped into the pond and the pond has in

fact now become a dump yard, as a result of which, the nearby soil is being damaged and vegetation is adversely effected and the contaminated water of the pond is leading to health hazards.

Having regard to the allegations made in the OA, we are of the opinion that a substantial issue relating to the environment is involved in the OA.

At  this  stage,  we  deem  it  proper  to  constitute  a  Committee comprising of the Secretary, Haryana State Pollution Control Board and concerned Superintending Engineer, Irrigation Department of State of Haryana, representative of Ground Water Department and Sarpanch of the Gram Panchayat, Dhaliawas. The Superintending Engineer will act as nodal agency. The Committee will inspect the pond in question, get the water analysis report of the water of the pond and also ascertain the source of pollution in the pond and submit a report within two months before Respondent- Chairperson, Haryana Pond & Waste Water Management Authority who will duly consider the report and ensure that the remedial measures are taken within three months of the receipt of the report. HPWWMA will send the action taken report before the Registrar General of the Tribunal within six months by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF. If found necessary, the matter will be listed before the Bench for consideration.

The Original Application is accordingly disposed of.
