Judgment
This O.A. is registered on the basis of the letter received from one Amir Khan, Resident of Okhal, Tehsil Naraingarh, District Ambala, Haryana. The allegation is that there is a pond admeasuring about 2 canal in the village for collection of dirty water and that with the collusion of the panchayat the surrounding area of the pond has been illegally captured as a result of which general public is facing inconvenience and further that the dirty water is getting collected in the drains which is leading to water pollution and damage to the environment.
The allegation made in the letter reveals that substantial question of law relating to environment is involved; hence at this stage we form a Joint Committee comprising of the Secretary, Haryana State Pollution Control Board and the District Magistrate, Ambala, Haryana.
District Magistrate will act as the nodal agency. The two member committee will visit site, ascertain the factual position and submit a report containing remedial measures also before the Registrar General of the NGT on receipt of the report, if found necessary the matter will be listed before this Tribunal.
