Judgment
Ahanthem Bimol Singh, J
[1] Heard Mr. M. Hemchandra, learned senior counsel assisted by Md. Juno Rahaman, learned counsel appearing for the petitioner and Mr. Niranjan Sanasam, learned GA appearing for the respondents.
[2] In view of the limited prayer made on behalf of the petitioner and as agreed to by the learned counsel appearing for the parties, the present writ petition is disposed of at the motion stage.
[3] At the outset, Mr. M. Hemchandra, learned senior counsel submitted that the petitioner will be satisfied for the time being if the present writ petition is disposed of by issuing a direction to the Chief Secretary, Government of Manipur, to consider the representation dated 28-06-2024 submitted by the petitioner on its own merit and strictly in terms of the rules and guidelines and to dispose of the same by issuing a speaking order within a stipulated period.
[4] Mr. Niranjan Sanasam, learned GA appearing for the respondents fairly submitted that as the prayer of the petitioner is confined to the consideration and disposal of the representation submitted by the petitioner, he has no objection in disposing of the present writ petition as prayed for by the learned senior counsel appearing on behalf of the petitioner.
[5] In view of the submission made above by the learned counsel appearing for the parties and on perusal of the records, this Court is of the considered view that interest of justice will be served by disposing of the present writ petition with the following directions:-
(i) The petitioner is directed to resubmit a fresh copy of the representation dated 28-06-2024 along with a copy of this order to the Chief Secretary, Government of Manipur for his consideration with a period of one week from today.
(ii) In the event of receiving such a representation as directed above, the Chief Secretary, Government of Manipur is hereby directed to consider the said representation on its own merit and strictly in terms of the applicable rules and guidelines and to dispose of the same by issuing a speaking order within a period of 1(one) month from the date of receipt of the said representation.
[6] With the aforesaid directions, the present writ petition is disposed of.
