Heard learned counsels for petitioners and for State.

The petitioners are apprehending their arrest in connection with Bariyatu P.S. Case No.12 of 2026, for offence registered under section 15(c), 18(b), 22, 25, 29 of the NDPS Act, pending in court of learned Sessions Judge Cum Special Judge, NDPS, at Latehar.

Learned counsel for petitioners submits that the petitioners have been falsely implicated in this case and the allegations are made of cultivation of poppy plants in the forest land and the petitioners are the villagers having no criminal antecedent as disclosed in paragraph no.19 of the petition and the co-accused has been granted anticipatory bail in ABA No.4590 of 2026.

Learned State counsel opposes prayer and submits that the allegations are there of cultivation of poppy plants in the forest land.

Considering that the land is of the forest department and that is not belonging to the petitioners and the petitioners are said to be villagers having no criminal antecedent as aforesaid and one of the co-accused person has been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Sessions Judge Cum Special Judge, NDPS, at Latehar, in connection with Bariyatu P.S. Case No.12 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
