Judgment
2/18.08.2026 Heard learned counsels for petitioners and for State.
The petitioners are apprehending their arrest in connection with Complaint Case No.1143 of 2021, for offence registered under section 33(1)(C) of Indian Forest Act, pending in court of learned Chief Judicial Magistrate, Chatra.
Learned counsel for petitioner submits that the petitioners has been falsely implicated in this case and the allegations are made of cultivation of poppy plants in the forest land. He also submits that the said land is not belonging to the petitioners and the petitioners are innocent villagers having no criminal antecedent as disclosed in paragraph no.12 of the petition.
Learned State counsel opposes the prayer and submits that allegations are there of cultivation of poppy plants in the forest land.
Considering that the land is not belonging to the petitioners and that is belonging to the forest department and further the petitioners are said to be villagers having no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners.
Accordingly, the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Complaint Case No.1143 of 2021, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
