2/06.08.2026 Heard learned counsels for petitioners and for State.

The petitioners are apprehending their arrest in connection with Complaint Case No.496 of 2026, for offence registered under section 33(1)(C) of Indian Forest Act, 1927, pending in court of learned Additional Chief Judicial Magistrate, Chatra.

Learned counsel for petitioners submits that false allegations are made against the petitioners of cultivation of poppy plants in the forest land. He next submits that the petitioners are poor villagers and they are having no criminal antecedent as disclosed in paragraph no.9 of the petition.

Mr. Chatterjee, the learned counsel appearing for the respondent State opposes the prayer and submits that allegations are there of cultivation of poppy plants in the forest land.

Considering that the land is of the forest department and the same is not belonging to the petitioners and the petitioners are having no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Additional Chief Judicial Magistrate, Chatra, in connection with Complaint Case No.496 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
