Judgment
2/11.08.2026 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Herhanj P.S. Case No.08 of 2026, for offence registered under sections 17, 18, 29 of the N.D.P.S. Act, pending in court of learned Special Judge, NDPS, Latehar.
Learned counsel for petitioner submits that the petitioners have been falsely implicated in this case alleging that the petitioner was doing cultivation of poppy plant on the forest land. He next submits that the co-accused persons have been granted anticipatory bail in ABA No.2468 of 2026. On these grounds, he next submits that anticipatory bail may kindly be granted.
Learned State counsel opposes prayer and submits that allegations are there of cultivation of poppy plant in the forest land.
Considering that the land is of the forest department and is not belonging to the petitioner and co-accused persons have been granted anticipatory bail in ABA No.2468 of 2026, I am inclined to grant anticipatory bail to the petitioner.
Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned Special Judge, NDPS, Latehar, in connection with Herhanj P.S. Case No.08 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
